TERMS AND CONDITIONS OF THE ONLINE STORE

Krośko The Weaver / Krośko Ten Tkacz

§1. General Provisions

  1. These Terms and Conditions govern the use of the online stores available at:
  1. operated under the brands "Krośko The Weaver" and "Krośko Ten Tkacz".
  2. The Seller is Jakub Fikowicz-Krośko, operating an unregistered business in accordance with applicable Polish law, under the brands "Krośko The Weaver" and "Krośko Ten Tkacz".

  4. These Terms and Conditions define in particular:
  • the rules for using the Store,
  • the procedure for placing orders,
  • the conditions for concluding sales agreements,
  • payment terms,
  • delivery conditions,
  • the right of withdrawal,
  • complaint procedures.
  1. Customers are required to read these Terms and Conditions before placing an order.
  2. Acceptance of these Terms and Conditions is required in order to place an order.
  3. These Terms and Conditions are made available free of charge through the Store in a manner allowing them to be saved, downloaded, and printed.

§2. Definitions

For the purposes of these Terms and Conditions:

  1. Seller – Jakub Fikowicz-Krośko operating an unregistered business under the brands "Krośko The Weaver" and "Krośko Ten Tkacz".
  2. Store – the online store operated at:
  1. Customer – a natural person, legal entity, or organisational unit purchasing products through the Store.
  2. Consumer – a natural person acting for purposes outside their trade, business, craft, or profession.
  3. Product – a movable item offered for sale through the Store.
  4. Order – a declaration of intent submitted by the Customer aimed directly at concluding a sales agreement.
  5. Sales Agreement – an agreement concluded between the Customer and the Seller through the Store.
  6. Custom Order – a Product made according to specifications or individual requirements provided by the Customer.
  7. Business Day – any day from Monday to Friday excluding public holidays in Poland.

§3. Technical Requirements

  1. Using the Store requires:
  • a device with Internet access,
  • an up-to-date web browser,
  • an active e-mail address.
  1. The Seller makes reasonable efforts to ensure the proper functioning of the Store.
  2. The Seller shall not be liable for difficulties resulting from:
  • failures of telecommunications networks,
  • actions of Internet service providers,
  • incompatibility of hardware or software used by the Customer.
  1. Customers agree to use the Store in compliance with applicable law and good practice.

§4. Product Information and the Nature of Handmade Craftsmanship

  1. The Store offers handmade textile products, including:
  • scarves,
  • decorative textiles,
  • cushion covers,
  • textile artworks,
  • other products presented in the current offer.
  1. Products offered through the Store are handmade by the Seller on a weaving loom.
  2. Products may be created as:
  • one-of-a-kind pieces,
  • small series,
  • custom orders.
  1. Due to the handmade nature of the creative process and the use of natural materials, individual pieces may vary slightly in:
  • dimensions,
  • textile structure,
  • yarn tension,
  • edge finishing,
  • pattern placement,
  • colour tone.
  1. The differences described above are not considered defects.
  2. Each Product may bear subtle traces of the handmade process, which form an integral part of its artistic character.
  3. Products made from natural fibres may display characteristics typical of the material used, including:
  • minor pilling,
  • natural settling of fibres,
  • changes in softness,
  • other properties resulting from the natural origin of the material.
  1. Product photographs are provided for illustrative purposes.
  2. While every effort is made to accurately represent Products, actual colours may differ slightly depending on the Customer's screen settings.
  3. Detailed information regarding product care and maintenance is available in the separate "Care Guide".

§5. Placing and Processing Orders

  1. Orders may be placed through the Store 24 hours a day.
  2. To place an order, the Customer shall:
  • select a Product,
  • add the Product to the shopping cart,
  • provide information necessary for order fulfilment,
  • choose a delivery method,
  • choose a payment method,
  • accept these Terms and Conditions,
  • confirm the order.
  1. Submission of an order constitutes an offer to conclude a sales agreement.
  2. After receiving an order, the Seller will send an e-mail confirming receipt of the order.
  3. A Sales Agreement is concluded when the Seller accepts the order for processing and sends confirmation to the Customer by electronic means.
  4. The Seller reserves the right to refuse processing an order in the event of:
  • product unavailability,
  • incorrect customer information,
  • circumstances beyond the Seller's reasonable control.
  1. If an order cannot be fulfilled, the Customer will be informed promptly and any payment received will be refunded.

§6. Prices and Payment Methods

  1. Product prices are displayed in Polish złoty (PLN) or euro (EUR).
  2. All prices displayed in the Store are gross prices.
  3. Product prices do not include delivery costs unless explicitly stated otherwise.
  4. Delivery costs are displayed before the Customer places an order.
  5. Available payment methods may include:
  • Przelewy24,
  • PayPal,
  • bank transfer,
  • other payment methods currently available in the Store.
  1. The Seller reserves the right to modify available payment methods without amending these Terms and Conditions.
  2. Orders are processed after payment has been received unless otherwise specified for a particular payment method.

§7. Delivery

  1. The Seller delivers Products within Poland and to selected international destinations.
  2. Current delivery destinations, estimated shipping times, and shipping costs are specified in the separate "Shipping Policy".
  3. Availability of shipping to particular countries may change over time.
  4. For international shipments, the Customer is responsible for any customs duties, import taxes, VAT, handling fees, or other charges imposed by the destination country.
  5. Risk of accidental loss or damage to the Product passes to the Consumer upon delivery.

§8. Right of Withdrawal

  1. Consumers have the right to withdraw from a distance sales agreement without giving any reason within 14 days from the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes possession of the Product.
  2. To meet the withdrawal deadline, it is sufficient to send the withdrawal statement before the withdrawal period expires.
  3. A withdrawal statement may be submitted:
  • by e-mail to: kroskotheweaver@gmail.com,
  • in writing to the Seller's address specified in §1.
  1. The withdrawal statement should include at least:
  • Customer's full name,
  • Customer's address,
  • order number,
  • date of purchase or delivery,
  • a clear statement of withdrawal,
  • bank account details if reimbursement cannot be made through the original payment method.
  1. The Consumer shall return the Product without undue delay and no later than 14 days after notifying the Seller of the withdrawal.
  2. The direct cost of returning the Product shall be borne by the Consumer.
  3. Returned Products should not show signs of use beyond what is necessary to establish their nature, characteristics, and functioning.
  4. The Seller will reimburse all payments received from the Consumer, including delivery costs corresponding to the least expensive standard delivery option offered by the Seller.
  5. Reimbursement will be made no later than 14 days after receipt of the withdrawal notice. The Seller may withhold reimbursement until the Product has been returned or proof of return has been provided.
  6. Reimbursement will be made using the same payment method used by the Consumer unless otherwise agreed.

§9. Exceptions to the Right of Withdrawal

  1. The right of withdrawal does not apply where permitted by applicable law, particularly in relation to Products made according to the Consumer's specifications or clearly personalized products.
  2. Custom Orders include, in particular:
  • products made to specific dimensions,
  • individually selected colours,
  • custom-developed designs,
  • modifications requested by the Customer,
  • other features agreed individually between the Customer and the Seller.
  1. Information regarding the absence of a right of withdrawal for a Custom Order will be provided before the agreement is concluded.

§10. Complaints and Product Conformity

  1. The Seller is liable for any lack of conformity of a Product with the Sales Agreement in accordance with applicable law.
  2. A Product is considered conforming if it:
  • matches its description,
  • is suitable for the purposes for which products of that type are normally used,
  • possesses characteristics reasonably expected by the Consumer.
  1. Characteristics resulting from the handmade nature of the Product as described in §4 do not constitute grounds for complaint, provided that the Product remains consistent with its description.
  2. Complaints may be submitted:
  • by e-mail to kroskotheweaver@gmail.com,
  • in writing to the Seller's address.
  1. Complaints should include:
  • Customer details,
  • order number,
  • description of the issue,
  • date on which the issue was identified,
  • photographs where reasonably possible.
  1. The Seller will review complaints without undue delay and respond within the period required by applicable law.
  2. If a complaint is accepted, the Seller will proceed in accordance with the remedies available under applicable law.

§11. Personal Data

  1. Personal data is processed in accordance with applicable law, including the General Data Protection Regulation (GDPR).
  2. The data controller is Jakub Fikowicz-Krośko.
  3. Personal data is processed solely for purposes including:
  • order fulfilment,
  • payment processing,
  • handling complaints and returns,
  • customer communication,
  • compliance with legal obligations.

§12. Copyright and Intellectual Property

  1. All content published within the Store is protected by copyright and other intellectual property laws.
  2. Protection applies in particular to:
  • product photographs,
  • product descriptions,
  • written content,
  • graphic materials,
  • textile designs,
  • weaving patterns,
  • design documentation,
  • compositional elements of patterns visible in photographs,
  • the "Krośko The Weaver" logo,
  • the "Krośko Ten Tkacz" logo,
  • the visual identity of the brand.
  1. Access to such materials does not grant the Customer any intellectual property rights or licence unless expressly stated otherwise.
  2. Without prior written consent of the Seller, it is prohibited to:
  • copy,
  • reproduce,
  • publish,
  • distribute,
  • modify,
  • commercially exploit
  1. any materials available through the Store.
  2. Purchasing a Product does not transfer copyright or ownership of the underlying design, pattern, or documentation.
  3. All rights to textile designs and related creative works remain with the Seller unless otherwise agreed in a separate written agreement.

§13. Alternative Dispute Resolution

  1. Consumers may use out-of-court complaint and dispute resolution procedures available under applicable law.
  2. Information regarding such procedures can be obtained from:
  • the Polish Office of Competition and Consumer Protection (UOKiK),
  • competent consumer protection authorities.
  1. Consumers may also use the European Online Dispute Resolution (ODR) platform where available and applicable.

§14. Final Provisions

  1. These Terms and Conditions shall be governed by Polish law.
  2. These Terms and Conditions are available in both Polish and English.
  3. The English version is provided for convenience and informational purposes.
  4. In the event of discrepancies between the Polish and English versions, the Polish version shall prevail.
  5. The Seller reserves the right to amend these Terms and Conditions for important reasons, including:
  • changes in applicable law,
  • changes in the operation of the Store,
  • expansion or limitation of offered services,
  • changes to the Seller's details.
  1. Amendments shall not affect rights and obligations arising from agreements concluded before such amendments take effect.
  2. If the Seller changes the legal form of business activity, including registration of a business, the Seller's identification details may be updated accordingly without affecting previously concluded agreements.
  3. These Terms and Conditions enter into force on the date of publication in the Store.
